Neutral Citation No. - 2025:AHC:73304-DB Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 9158 of 2025 Petitioner :- Ranveer Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Anju Kushwaha,Gagan Pratap Singh,Rohit Kumar Kushwaha Counsel for Respondent :- G.A. Hon'ble Vivek Kumar Birla,J. Hon'ble Jitendra Kumar Sinha,J. 1. Heard Shri Gagan Pratap Singh, learned counsel for the petitioner and Shri Pankaj Kumar, learned A.G.A for the State respondents. 2. The relief sought in this petition is for quashing of the F.I.R. dated 26.01.2025, registered as Case Crime No. 10 of 2025, under Section 3/5A/8 of Prevention of Cow Slaughter Act, 11 of Prevention of Cruelty to Animals Act and Section 111 and 61(2) of B.N.S., Police Station Bankata, District Deoria. Further prayer has been made not to arrest the petitioner in the aforesaid case. 3. Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated and no offence is made out against the petitioner. It is submitted that the petitioner has no knowledge whatsoever about the incident as given in the impugned first information report as the petitioner has already sold his vehicle way back on 29.11.2024 to one Mohammad Yunuf and therefore, he has no concern with the vehicle and was not aware as to whether the vehicle was being used for committing offence. 4. Per contra, learned AGA pointed out that a bare glance over the FIR, it is clear that the offences have been levelled against the petitioner that 22 animals were being carried in the vehicle and the petitioner is the owner of the vehicle and it was specifically alleged by the co-accused persons arrested on the spot that the vehicle owner was involved in the act. We find that Section 111 B.N.S., which relates to organize crime has also been levelled against the petitioner. The transfer of vehicle on notarial Stamp paper is not a valid transaction of sale and there is no proof of sale or transfer of vehicle in the record of transport authority. In any case transfer of vehicle on stamp paper is nothing but defence of the petitioner. A bare perusal of the FIR clearly discloses cognizable offence. 5. Apart from the above, learned AGA pointed out that against three co-accused persons, namely, Babar, Saddam and Ansar Charge sheet No. A-41/2025 has been forwarded on 20.04.2025 in the present case. We therefore, find that there can be no part quashing of the first information report. 6. In such view of the matter, the petition is devoid of merit and is liable to be dismissed. 7. The writ petition is dismissed.
