GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue an appropriate writ or order more particularly one in the nature of writ of Mandamus declaring the action of the respondents especially respondents 4 and 5 in interfering in civil matters and insisting the petitioner to settle the issue with the 6th respondent by evicting the property in an extent of 144 Sq.Yds(out of 288 Sq.Yds) bearing plot No.25 situated in Sy.No.86/4,86/5 and 86/6 of 2 Hukumpeta, Kadiam Mandal, East Godavari District under threat of implicating the petitioner and his family members in false criminal cases without having any authority or right what so ever and to declare the same illegal, arbitrary, unjust, discriminatory and also in violation of principles of natural justice apart from violation Art 14,19,21 and 300-A guaranteed under Constitution of India and consequently direct the respondents 3 and 5 not to interfere or insist the petitioner and his family members to settle the issue with the 6th respondent.” 2. Heard G.L.Nageswar Rao, learned counsel for the petitioner and Sri Ajay Babu, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home would submit that, on the complaint made by the unofficial respondent, the petitioner was called to the police station for a preliminary enquiry, and the same was entered in the General Diary. No crime has been registered in this regard. Learned Assistant Government Pleader would further submit that the police are not interfering in the civil disputes between the parties. 4. Considering the submissions made, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. There shall be no order as to costs.
