GP FOR REVENUE 3 HBKM,J W.P.No.12806 of 2020 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents particularly the respondent No.3 in obstructing the cultivation of raising crops and construction of cattle and poultry shed of the petitioners' lands in order to stop the petitioners' agriculture and its connected activities in Sy.No.283/2 of Anandapuram village in respect of the patta lands belonging to the petitioner Nos.1 to 3 to an extent of Ac.0.49 cents, Ac.0.24 cents and Ac.0.36 cents respectively with a view to evict the petitioners and assign the same under the Scheme Navaratnalu for house sites without following the due process of law. 3. The learned counsel for the petitioners submits that the petitioners were given D-form pattas for the subject land. 4. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 3rd respondent dated 23.09.2025 submits that as per the revenue records, the land in Sy.No.283/2 of Anandapuram Village with a total extent of Ac.4.40 cents is a Government land classified as “Gedda Poramboke” (which is an objectionable poramboke) and as such the Government is the absolute owner with the clear title and possession over the subject land. Wherein an extent of Ac.1.26 cents was covered under the expansion of National Highways-16 and in the remaining extent of Ac.3.14 4 HBKM,J W.P.No.12806 of 2020 cents there exists four unauthorized asbestos small shed without any power connection installed nor tax assessment was raised years before passing of the interim order dated 30.07.2020 in this writ petition. At present the remaining extent of Ac.3.14 cents is covered by bushes and moreover the above said four sheds are unutilized for the last so many years and there is further development in the subject land. 5. In view of the above said facts and circumstances, the respondent Nos.2 and 3 are directed to deal with the subject land in an extent of Ac.0.49 cents, Ac.0.24 cents and Ac.0.36 cents respectively in Sy.No.283/2 of Anandapuram village, strictly in accordance with law, if so warranted for any public purpose and if not already utilized the same for the above said public purpose of housing scheme for the poor. If the petitioners are otherwise found to be in possession of the same, they shall be dealt with strictly in accordance with law, by hearing all the parties concerned, including the petitioners, upon verification of the records and the subject land an appropriate decision shall be taken on its own merits. If the land is under any form of illegal occupation, then it shall be protected strictly in accordance with law by removing such illegal occupation if any for the purpose of utilizing the same in future for any public purpose. 6. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs. The 5 HBKM,J W.P.No.12806 of 2020 written instructions of the 3rd respondent dated 23.09.2025 shall be made as part of the Court record.
