...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or order, orders or directions more particularly one in the nature of Writ of Mandamus - declaring the action of the 5th respondent in not allotting the works to any bidder who submitted their bidsin pursuant to the Tender Notification dt.20-03-2023 issued vide R.O.C. No.10/2023 and also not even allotting the works to the petitioners who submitted the lowest bid i.e., Rs.233/- and Rs.222/- per person in pursuant to the Tender Notification dt.20-03-2023 issued vide R.O.C.No.10/2023 to maintain water supply and also maintaining street lights from 01-04-2023 to 1-03-2024 respectively is illegal, arbitrary and violative of principles of natural justice as illegal, arbitrary, discriminative, mala fide, unjust, colorable exercise of powers besides violative of the Arts.14 AND 21 of the Constitution of India and Consequently, direct the 5th respondent to allot the works to the petitioners who submitted the lowest bid i.e., Rs.233/- and Rs.222/- per person in pursuant to the Tender Notification dt.20-03-2023 issued vide R.O.C. No.10/2023 to maintain water supply and also maintaining street lights from 01-04-2023 to 1-03-2024 respectively and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 5th respondent to allot the works to the petitioners who submitted the lowest bid i.e., Rs.233/- and Rs.222/- per person in pursuant to the Tender Notification dt.20-03-2023 issued vide R.O.C. The Court made the following order:
Challenging the action of respondent No.5 in not allotting the works to any bidder, who submitted their bids, in pursuant to the Tender Notification dated 20.03.2023 issued vide ROC No.10/2023 and also not even allotting the works to the petitioners, who submitted the lowest bid i.e., Rs.233/- and Rs.222/- per person in pursuant to the Tender Notification dated 20.03.2023 to maintain water supply and also maintaining street lights from 01.04.2023 to 01.03.2024, the present Writ Petition has been filed. When the matter is taken up for consideration today, Sri Y.Koteswara rao, learned standing counsel for Gram Panchayat, submits that the said Tender Notification has been withdrawn. Recording the said submission, since the Tender Notification has been withdrawn, there remains nothing for adjudication in this matter. Accordingly, the Writ Petition is dismissed as infructuous.
