No.4755 of 2025 In all these matters, learned AGA having argued the matter at length, now very fairly submits that order of the learned Single Judge would be given effect to, inasmuch as it has only directed consideration of the case in the light of order dated 03.02.2021 passed by a Co-ordinate Bench of this Court in W.P.(C) No.38771 of 2020 between Pradip Kumar Panigrahi v. State of Odisha. We are told at the Bar that this decision on being p. 2 challenged before the Apex Court, has been affirmed and thus has attained finality in SLP (C) Diary No(s).50364 of 2023 disposed off on 02.01.2024. 2. Furthermore, these Intra-Court appeals are moved by the State after brooking a varying delay. Although applications supported by affidavits are filed for condoning the delay, the explanations offered in the applications are not plausible and unaccepted. There cannot be different yardstick for the State and its Officials when it comes to the limitation period, of course with all just exceptions. Therefore, the applications are thoroughly unworthy of lenient consideration. In view of the above, nothing survives for consideration in these appeals and accordingly they are disposed off, costs having been made easy. The orders of the learned Single Judge shall be implemented within an outer limit of eight weeks. It is open to the decision-maker to solicit any information/documents from the side of employees, however subject to the rider that in that guise, delay shall not be brooked.
