1. By the present writ petition, the petitioner is questioning the (Annexure P/1) dated 16.03.2024, by which the Assistant Engineer, Project Execution Unit No. 2 has been posted as Executive Engineer . The grievance of the petitioner is that the respondent no. 4 who is junior to the petitioner as per the gradation list has been assigned the charge of Executive Engineer for which the petitioner has submitted a representation before the Under Secretary Department of Panchayat and Rural Development vide (Annexure P/3) on dated 17.12.2024.
2. Learned counsel for the petitioner submits that the representation is still pending and no decision has been taken on the said representation.
3. Learned counsel for the State submits that if the representation is still pending, the same shall be considered in accordance with law within a stipulated period.

4. In view of the submission made by the State counsel, the writ petition is disposed of with a direction to the respondent Under Secretary to decide the representation within a period of 50 days from receipt of the order in accordance with law. Sd/-
