Sr. No. 39 HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU WP(C) No. 3103/2024 CM No. 7672/2024 Girdhari Lal …. Petitioner/Appellant(s) Through:- Mr. Jagmohan Singh, Advocate V/s Union Territory of J&K & ors. …..Respondent(s) Through:- Mrs. Monika Kohli, Sr. AAG CORAM : HON’BLE MRS. JUSTICE SINDHU SHARMA, JUDGE ORDER 01.01.2025 01. Petitioner seeks a direction to the respondents to consider the application of the petitioner seeking demarcation of land measuring 02 Kanals 13 Marlas falling under Khasra No. 14 situated at Gumpul Domana, Tehsil & District Jammu. 02. The short grievance of the petitioner is that the land measuring 02 Kanals 13 Marlas falling under Khasra No. 14 situated at Gumpul Domana, Tehsil & District Jammu has been devolved upon the petitioner as well as his brother and accordingly, the petitioner approached the Tehsildar Jammu North Janipur, Jammu for demarcation of the aforesaid land. 03. Respondent No. 2 issued direction to Naib Tehsildar Mishriwala i.e., respondent No. 3 seeking report but respondent No. 3 did not take any step in this regard. It is submitted that respondent No. 4 has submitted a report without taking any necessary steps to carry 2 out the demarcation and delayed the same on the ground that the demarcation cannot be conducted without police protection and due to breach of peace in this regard. It is submitted by the petitioner that as per the report dated 30.04.2024, demarcation has not been conducted, however, the application of the petitioner has been disposed of pursuant to order date 06.06.2024 but till date nothing has been done in this regard. 04. Keeping in view the fact that there is already an order dated 06.06.2024 passed for demarcation of the land, it would be appropriate to direct the respondents to conduct demarcation of the land. 05. Notice. Mrs. Monika Kohli, learned Sr. AAG accepts notice on behalf of the respondents and states that she has no objection to the same. 06. With the consensus of the parties, this petition is disposed of with a direction to the respondents to conduct the demarcation of the land measuring 02 Kanals 13 Marlas falling under Khasra No. 14 situated at Gumpul Domana, Tehsil & District Jammu, in accordance with law, within a period of six weeks from the date copy of this order is made available to the respondents by the petitioner himself. 07. This petition stands disposed of as such. (SINDHU SHARMA) Judge JAMMU RAM MURTI/PS 01.01.2025 Ram Murti 2025.01.03 12:46 I attest to the accuracy and integrity of this document
