They claim that their names were included in the ineligible voters list on the ground that they had not supplied 270 liters of milk every year in the last five years. They contend that before including their names - 14 - HC-KAR NC: 2025:KHC:39417 WP No. 29044 of 2024 C/W WP No. 29163 of 2024 WP No. 29182 of 2024 AND 4 OTHERS in the list of ineligible voters, notices under Rule 13-D(2) of the Karnataka Co-operative Societies Rules, 1960 (hereinafter referred to as the “Rules, 1960”) were issued to them. They submitted appropriate replies setting out the reasons for not supplying 270 litres of milk, which is the fundamental criteria required for inclusion in the list of eligible voters. The petitioners contend that due to the outbreak of Covid-19, and on account of foot and mouth disease and certain skin diseases affecting the cattle, they were unable to supply milk during the relevant period. They submitted that the respondents ought to have considered their genuine explanation and must have included their names in the list of eligible voters. 3. Yet another ground urged by some of the petitioners is that they had supplied the stipulated quantity of milk. However, due to a conspiracy at the chilling centre of the federal society, the fat percentage of the milk supplied by them was reduced, as certain workers of the federal society had adulterated the milk and that three officials were placed under suspension. The petitioners therefore contend that though they had supplied the requisite quantity of milk and were be eligible - 15 - HC-KAR NC: 2025:KHC:39417 WP No. 29044 of 2024 C/W WP No. 29163 of 2024 WP No. 29182 of 2024 AND 4 OTHERS members, they were disqualified on the ground that the fat content in the milk supplied was below the prescribed percentage. They contend that neither the byelaws nor the provisions of the Karnataka Co-operative Societies Act, 1959 prescribe that the milk which does not contain the specified percentage of fat could be a ground to treat a member as ineligible. They further contend that the federal society had not rejected or returned the milk supplied by them. Hence, they submit that the ground on which their names have been included in the list of ineligible voters is per se arbitrary and that their names are liable to be restored in the list of eligible voters. 4. Per contra, the learned Additional Government Advocate submits that the question whether the petitioners had any genuine grievance in not supplying the minimum quantity of milk did not arise for consideration before the Election Officer as his duty was only to ascertain whether the petitioners had in fact supplied the requisite quantity of milk or not. He therefore, contends that the inclusion of the petitioners' name in the list of - 16 - HC-KAR NC: 2025:KHC:39417 WP No. 29044 of 2024 C/W WP No. 29163 of 2024 WP No. 29182 of 2024 AND 4 OTHERS ineligible voters for not supplying the minimum required quantity of milk is just and proper. 5. As regards the contention of some of the petitioners that they had supplied minimum quantity of milk but federal society had treated such milk as being below the prescribed standard, he submits that the petitioners were required to supply milk of good quality, and that the federal society was of the opinion that the milk supplied did not contain 8.5% SNF. He therefore contends that this Court cannot embark upon an enquiry as to whether the milk supplied by the petitioners met the quality standard prescribed by the federal society. 6. In any event, he submits that these are all questions falling within the jurisdiction of the competent authority under Section 70 of the Karnataka Co-operative Societies Act, 1959, who has to consider and decide in accordance with law. Hence, he contends that this Court, while exercising jurisdiction under Article 226 of the Constitution of India, ought not to entertain such disputed factual questions. In support of his submissions, he places reliance on the judgment of a Coordinate bench of this Court in the case of B.Ganganna - 17 - HC-KAR NC: 2025:KHC:39417 WP No. 29044 of 2024 C/W WP No. 29163 of 2024 WP No. 29182 of 2024 AND 4 OTHERS and others Vs. State of Karnataka and others [ILR 2024 KAR 1901]. 7. I have considered the submissions of learned counsel for the petitioners as well as learned Additional Government Advocate for the officials respondents. 8. It is not in dispute that one of the conditions prescribed for a primary society to be eligible to vote at an election to federal society is that it should have supplied a minimum quantity of 270 liters of milk during the previous Co- operative years. None of the petitioners have disputed that they have complied this requirement, which is stipulated under the bye-laws of the respondent-federal society. 9. Many of the petitioners in these writ petitions contend that though notices were issued to them stating that they had failed to supply the minimum quantity of milk, they had replied to those notices explaining their difficulty in supplying the required quantity of milk owing to Covid-19 and other reasons. However, as rightly contended by learned Additional Government Advocate, such explanations cannot be - 18 - HC-KAR NC: 2025:KHC:39417 WP No. 29044 of 2024 C/W WP No. 29163 of 2024 WP No. 29182 of 2024 AND 4 OTHERS considered by the Election Officer, who was only required to ascertain whether or not the petitioners had supplied the minimum quantity of milk. Since Election Officer had issued notices, considered the replies submitted by the petitioners, and thereafter included their names in the list of ineligible voters, the mandate under Rule 13(D)(2A) of Rules, 1960, stood complied with. Therefore, in all those petitions, where the petitioners have claimed that they were prevented by sufficient cause in supplying the required quantity of milk and that they ought to have been included in the list of eligible voters is not justified. 10. As regards, the other petitioners who contend that the quality of milk that was supplied to the federal society was not a ground on which they could be disqualified as eligible members, it is relevant to note that as per the bye-law of federal society, the primary societies were bound to comply with the following: G¥À «¢ü ¸ÀASÉå 13 CzsÁåAiÀÄ-13/Chapter-13 ¸ÀzÀ¸Àå ¸ÀAWÀzÀ ºÀPÀÄÌUÀ¼ÀÄ ªÀÄvÀÄÛ ºÉÆuÉUÁjPÉUÀ¼ÀÄ Rights & Responsibilities of a Member Society - 19 - HC-KAR NC: 2025:KHC:39417 WP No. 29044 of 2024 C/W WP No. 29163 of 2024 WP No. 29182 of 2024 AND 4 OTHERS 13.1 MPÀÆÌlzÀ ¸ÀzÀ¸Àå ¸ÀAWÀªÀÅ- J) MPÀÆÌlPÉÌ ¥Àæw ¸ÀºÀPÁgÀ ªÀµÀðzÀ°è ¸ÀgÁ¸Àj 270 ¢£ÀUÀ¼ÀÄ ¥Àæw ¢£À 150 PÉ.f. Fails to supply milk for minimum 270 days in every cooperative year on an average 150 Kgs Milk to the Union as per the terms and conditions. 3. Failed to utilize such minimum services of facilities as may be specified in the byelaws for any two Co-operative years. 4. If the member society is continuously defunct for 90 days/ board of management is rescinded/ liquidated. 6. If a member Society has defaulted in the repayment of loan or payment of any other dues, 7. A Society who has become a member of the Union within a period of twelve months immediately prior to date of such meeting/ election of the directors. 11. The primary milk producing societies were not only bound to supply minimum quantity of milk but also to ensure that the milk supplied subscribes to the quality prescribed by the Apex Milk Union. It is undisputed that the quality prescribed was that the milk should have SNF of 8.5%. The petitioners who were treated as ineligible to vote as they did not supply quality milk have not denied that the milk supplied by them did not meet the prescribed quality but contend that someone in the chilling center had adulterated the milk supplied by them. This is an omnibus defense raised and there is no justifiable material. Be that as it may, all these petitioners have accepted the payment from the District Union which had considered the - 25 - HC-KAR NC: 2025:KHC:39417 WP No. 29044 of 2024 C/W WP No. 29163 of 2024 WP No. 29182 of 2024 AND 4 OTHERS milk supplied by them as not of standard quality and proportionately reduced the volume based on the fat percentage. None of the complaining petitioners have raised any dispute against the District Milk Union claiming that someone else in the chilling center had adulterated the milk and they were not liable. It is also relevant to note that when milk is deposited in the chilling center every day, the quality of milk would be checked. Therefore, it is unnatural for the petitioners to contend that someone in the chilling center had adulterated the milk. 12. In view of the above, W.P.Nos.29044/2024, 29163/2024, 29182/2024, 29189/2024, 29192/2024, 29195/2024 and 29377/2024 are rejected. Sd/- (R.
