Learned counsel for the petitioner submits that the aforesaid notice calling upon the petitioner to appear on 08.07.2025 was issued on the previous day i.e., 07.07.2025 and as such, it was not possible for the petitioner to comply with the said order. It is submitted that the notice was served on 07.07.2025 at around 4.00 p.m., and if sufficient time would have granted, he would appear and submit his reply and the respondent may be directed to consider the same and proceed further in accordance with law and till then, respondent may be directed not to take precipitative/coercive action against the petitioner nor arrest him. The aforesaid submission is placed on record. 5. A perusal of the aforesaid notice would clearly indicate that the same was issued on 07.07.2025 granting only for a short period of time for appearance i.e., on 08.07.2025, which is clearly inadequate and contrary to the guidelines issued in the cases of Arnesh Kumar vs. State of Bihar – (2014) 8 SCC 273, Satender Kumar Antil vs. CBI – (2022) 10 SCC 51 and Sri Tavaragi - 5 - HC-KAR NC: 2025:KHC:26058 WP No. 20782 of 2025 Rajashekhar Shiva Prasad Vs. The State of Karnataka and Ors – W.P.No.15125/2024 dated 19.07.2024. 6. Under these circumstances, I deem it just and appropriate to dispose of the petition by permitting the petitioner to appear before the respondent –Police on 28.07.2025 and submit his reply along with documents etc., which shall be considered by the respondent, who shall proceed further thereafter in accordance with law. 7. In addition thereto, respondents are directed not to take precipitative/coercive action against the petitioner nor arrest him till 28.07.2025 subject to the condition that petitioner shall co- operate with the ongoing investigation.
