2025:UHC:3083-DB IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL HON’BLE THE CHIEF JUSTICE SRI G. NARENDAR AND HON’BLE SRI JUSTICE ALOK MAHRA 25th APRIL, 2025 WRIT PETITION (PIL) No. 61 OF 2025 Sagar Khemariya …Petitioner Versus State of Uttarakhand and Others …Respondents Presence:- Mr. Puneet Kansal and Mr. Alok Kumar, learned counsel for the petitioner. Mr. J.S. Bisht, learned Standing Counsel for the State. Ms. Anjali Bhargava, learned counsel for respondent nos. 3 and 4. ---------------------------------------------------------------------- JUDGMENT: (per Mr. G. Narendar C.J.) Heard learned counsel for the petitioner and the learned Deputy Advocate General for the State. 2. The case of the petitioner is that M/s Chaman Lal Educational Trust, Roorkee, Haridwar is running three- four colleges from the same premises i.e. Chaman Lal Degree College, Chaman Lal Law College, Chaman Lal College of Pharmacy and the same is contrary to the UGC guidelines and also the Bar Council guidelines. 3. We have queried as to whether they have approached the competent authorities, namely, the UGC 1 2025:UHC:3083-DB and the Bar Council of India with their complaint, to which, petitioner’s counsel fairly submits that they have not made any effort to raise the issue with the competent authority. 4. In that view of the matter, we are of the opinion that the instant writ petition is premature. In the event, the petitioners are aggrieved by the actions of the educational trust, it is always open to them to raise issue with the competent authority and in the event of any in- action, thereafter, approach this Court. 5. The writ petition PIL is straightaway filed seeking for certain reliefs, maintainability of which, in our opinion, is doubtful. In that view of the matter, the writ petition is disposed of by granting liberty to petitioners to make representation to the concerned authorities. If such representation is made, the competent authorities shall consider and dispose of the same as expeditiously as possible. _______________ G. NARENDAR, C.J. _______________ ALOK MAHRA, J.
