B E F O R E HON’BLE MR. JUSTICE DEVASHIS BARUAH ORDER 22.01.2025
Heard Ms. M Acharyya, the learned counsel appearing on behalf of the petitioner.
2. This is an application filed under Article 227 of the Constitution challenging the order dated 04.11.2024 whereby the learned Trial Court i.e. the Court of the
Page No.# 2/2 learned Civil Judge, (Junior Division) No.2, Dhubri had rejected the application for adducing official witnesses. It is seen that by an order dated 23.07.2019, the defendants were debarred from furnishing any further DWs. The said order dated 23.07.2019 had not been put to challenge in any proceedings as submitted by the learned counsel appearing on behalf of the petitioner.
3. Taking into account that the evidence of the DWs had been already closed by the order dated 23.07.2019, this Court finds no infirmity in the order impugned in the instant proceedings i.e. the order dated 04.11.2024 passed in Misc.(J).Case No.222/2024.
4. Accordingly, the instant revision petition stands dismissed.
