PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 1006 of 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners herein/A1 to A3, seeking regular bail, in Crime No.174 of 2024 on the file of Kothakota Police Station, Visakhapatnam, registered for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the NDPS, Act. 2. Brief facts of the case are that, on 09.12.2024, at 08.00 hours, on receipt of credible information, the S.I of Police, Kothakota P.S., along with his staff and mediators rushed to near Gatreddi’s threshing floor, on the road of Kalyanapulova Village to Dondapudi forest Check Post and conducted vehicle checking. They apprehended the accused and seized 110 Kgs of Ganja along with other material under the cover of mediators report. Consequently, a case has been registered against the accused. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor representing the respondent/State. Perused the material on record. 4. The petitioners herein were arrested on 09.12.2024 and since then they have been in judicial custody. The quantity of contraband involved in present crime is 110 Kgs of Ganja, which is a commercial quantity. Learned Assistant Public Prosecutor submits that the case is still under investigation and some more witnesses are to be examined. Statutory period is also not over. 3 Learned Assistant Public Prosecutor vehemently opposed the petition in the light of Section 37 of NDPS Act. In view of the aforesaid facts and circumstances of the case, this Court does not find any grounds to consider the case of the Petitioners. 5. Accordingly, the Criminal Petition is dismissed.
