This petition is filed by accused No.3 under Section 483 of BNSS seeking grant of bail in Crime No. 185/2025 of Chamarajpet Police Station registered for the offence under Section 109, 115(2), 54, 3(5) of BNS.
2. Heard learned counsel for petitioner and learned Addl.SPP for respondent.
3. Learned counsel for the petitioner would contend that serious overt act is alleged against accused No.1 assaulting the injured with thermocol cutter. There is no serious overt act alleged against the petitioner. The allegation against the petitioner and other two accused is that they assaulted with hand. The injury said to have sustained by the injured are simple in nature and he has been discharged from the hospital. The major portion of

investigation is over. With this, she prayed to allow the petition.
4. Per contra, learned Addl.SPP would contend that the accusation against the petitioner is that he along with two others assaulted with the hand to the injured. The wound certificate of the victim indicates that he sustained three simple injuries.
5. Having heard learned counsels, the Court has perused the FIR, complaint and other materials placed on record.
6. Upon perusal of the averment of the first information, the accusation levelled against the petitioner is that he along with accused Nos. 1 and 2 assaulted with hand to the first informant. The serious overt act is alleged against accused No.1, who is stated to have assaulted the first informant with thermocol cutter on his cheeks. There is no serious overt act alleged against the petitioner. As the major portion of the investigation is over, the

petitioner is not required for custodial interrogation. The petitioner has made out a case for grant of bail with conditions. In the result, the following:
ORDER Petition is allowed. Petitioner is ordered to be released on bail in Crime No.185/2025 of Chamarajpet Police Station subject to following conditions:
(i) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court. (ii) Petitioner shall not threaten the prosecution witnesses either directly or indirectly. (iii) Petitioner shall appear before the jurisdictional Court and appear before the

trial Court on all dates of hearing unless exempted and co-operate with the speedy disposal of the case.
