This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.204/2024 registered at Police Station Gandai, District Khairagarh- Chhuikhadan- Gandai (C.G.) for the offence punishable under Section 34(1)(B), 34(2), 35, 59(A)(2) of the C.G. Case of the prosecution, in brief, is that on dated 06.09.2024 the police received secret information that co-accused Mirza Baris Bag who is the resident of Village Narmada illicit liquor in his house, on the basis of aforesaid information the police conducted raid and recovered 33 quarter country made liquor from the possession of co-accused, the police recorded memorandum statement where name of the other accused and present applicant disclosed. It is allegation against present applicant that the present applicant and other co-accused is that they have manufactured duplicate liquor. Hence this bail application. 3. Learned counsel for the applicant submits that this is the second bail application of the applicant and the first bail application was rejected by this Court on merits vide order dated 11/12/2024 in MCRC No.8084/2024. He would submit that co-accused Narsingh @ Kejri Verma has been granted bail by this Court in MCRC No.240/2025 on 29/01/2025, the applicant is in jail since 06/09/2024, charge sheet has been filed and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application and he would submit that the charge sheet has been filed in this case before the competent Court. 5. I have heard learned counsel for the parties and perused the case diary. 6.
From perusal of the records, it transpires that this is the second bail
3 application of the applicant and the first bail application was rejected by this Court on merits vide order dated 11/12/2024 in MCRC No.8084/2024 on the ground that the applicant had seven previous antecedents out of which three cases are under the Excise Act and all the three cases are pending, further there appears to be no new ground to entertain this second bail application. 7. Accordingly, the second bail application of the applicant- Rohit Babar, involved in Crime No.204/2024 registered at Police Station Gandai, District Khairagarh-Chhuikhadan- Gandai (C.G.) for the offence punishable under Section 34(1)(B), 34(2), 35, 59(A)(2) of the C.G. Excise Act 2015 and Section 318(4), 336(2), 336(3), 340(2), 3(5), 111(2), 238 of the BNS, is rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information. Sd/- Sd/-
