THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION NOs: 31348, 21626 and 30404 of 2025 COMMON ORDER:
1. The petitioner in W.P.No.31348 of 2025 submitted that he has filed an application under the BPS by invoking the G.O.Ms.No.225. It is submitted that the respondent authorities are required to consider the same application strictly in terms of G.O.Ms.No.225. 2. The learned counsel appearing for respondent Nos.5 and 6 submits that, apart from deviations, the petitioner has also encroached upon the respondent’s property. The said issue is the subject matter of adjudication before the competent civil court in O.S.No.1020 of 2017. Insofar as the grievance of the petitioner is concerned, the same would have to be addressed in pursuance of the issuance of G.O.Ms.No.225. 3. In view of the above submissions, it is left open to the 2nd respondent to consider the application submitted by the petitioner and pass appropriate orders in accordance with G.O.Ms.No.225. 4. The petitioner in W.P.No.21626 of 2025 has filed the writ petition alleging inaction on the part of the respondent Nos.2 to 4 in not proceeding further in pursuance of the confirmation orders passed by the respondent No.2 against the respondent No.5. 5. Considering the submissions made, it is left open for the respondent No.2 to consider the application of the 5th respondent for regularization in terms of G.O.Ms.No.225, in accordance with law. 8
6. The petitioner in W.P.No.30404 of 2025 has filed the writ petition challenging the provisional order dated 17.09.2025. However, subsequent to the said provisional order, the 2nd respondent issued a confirmation order, dated 10.11.2025. That apart, the petitioner has applied for regularization by invoking G.O.Ms.No.225. 7. In view of the same and the subsequent developments, it is left open for the 2nd respondent to consider the petitioner’s application in accordance with law and in terms of G.O.Ms.No.225. The respondent No.2 shall not take any coercive steps pending consideration and disposal of the petitioner’s application seeking regularization under G.O.Ms.No.225. 8. Accordingly, with the above directions these writ petitions are disposed off. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed.
