Heard learned counsel for the petitioner and learned A.G.A. for the State respondents. 2. The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 27.03.2025, registered as Case Crime No. 126 of 2025, under sections-64(1) and 115(2) of BNS and Section 3/4 of POCSO Act, Police Station Sikandramau, District Hathras, and for a direction to the respondents not to arrest the petitioner in pursuance of impugned First Information Report. 3. It appears from the record that on 08.05.2025, time was granted to the learned A.G.A. to obtain instruction, but the same has not been received till date, despite time granted to him. 4. Petition is disposed of directing that till cognizance is taken on police report under Section 173(2) Cr.P.C., by the court the respondents shall not arrest the petitioner pursuant to the First Information Report dated 27.03.2025, registered as Case Crime No. 126 of 2025, under sections-64(1) and 115(2) of BNS and Section 3/4 of POCSO Act, Police Station Sikandramau, District Hathras, subject to cooperation in ongoing investigation. 5. The investigation shall be completed by the police within a period of 60 days from the date of production of certified copy of this order. 6. In case, the petitioners do not cooperate the investigation, it shall be open for the Investigating Officer to file a recall application for recalling this order before this Court through learned A.G.A.
