ORAL ORDER
In this petition, the petitioners seek the following reliefs:
“To quash the chargesheet filed by the respondent No.1 in C.C.No.54175/2023 for the offence punishable under Sections 498A, 506, 420 of IPC and Sec 3 and 4 of D.P. Act, pending on the file of the Hon’ble 29th ACMM, at Mayohall, Bengaluru, in the interest of justice and equity.”

Learned counsel for the petitioners – accused Nos.1 to 3 and learned counsel for 2nd respondent – complainant have filed Application – I.A.1/2025 along with Joint Affidavit duly signed by the petitioners, 2nd respondent and their respective counsel and the same is taken on record. - 3 -

3. Petitioners – accused Nos.1 to 3 and their counsel and 2nd respondent and her counsel are physically present before the Court and they admit the contents of the Application and Joint Affidavit, which reads as under:-
“APPLICATION UNDER SECTION 320 OF R/W 428 OF CRIMINAL PROCEDURE CODE, 1973
The petitioners and Respondent No.2 submits as follows:
1. It is submitted that, the offences alleged in the C.C.No.54175/2023 are punishable under Section 498(A), 506, 420 of IPC and S.3 and 4 of D.P. Act which are pending in the file of the Hon'ble 29th A.C.M.M. at Mayohall, Bengaluru, for which there is no basis and the petitioners and respondent no.2 are husband and wife and have entered into compromise voluntarily and out of free will for the purpose of maintaining good relationship hereafter and not touching the interest of public and therefore to meet the ends of justice proceedings may be quashed. 2. It is submitted that, the petitioners have preferred the main petition to quash the chargesheet in C.C No.54175/2023 are punishable under Sections 498(A), 506, 420 of IPC and S.3 and 4 of D.P. Act which are pending in the file of the Hon'ble 29th A.C.M.M. at Mayohall, Bengaluru. - 4 -

3. It is submitted that, in view of intervention of the elder members of the family and relatives, petitioners and respondent No.2 have settled the dispute and the respondent No.2 has willfully agreed to withdraw the allegations made against the petitioners. Wherefore, the petitioners and the respondent No.2 prays before this Hon'ble Court the chargesheet in C.C No.54175/2023 are punishable under Section 498(A), 506, 420 of IPC and S.3 and 4 of D.P. Act which are pending in the file of the Hon'ble 29th A.C.M.M. at Mayohall, Bengaluru in the interest of justice and equity.”
“JOINT AFFIDAVIT
We. 1. MR ANEES AHMED S/o. Late Maqbool Ahmed Shariff, Aged about 35 years, Residing at no. 27/3, Serpentine street, Richmond town, Bangalore- 560025 2.
SYEDA ZEENATH UNNISA w/o. Late Maqbool Ahmed Shariff, Aged about 58 years, Residing at No.27/3, Serpartine Street, Richmond Town, Bangalore-560025 3. SUMAIYA BANU d/o. Late Maqbool Ahmed Shariff, Aged about 40 years, Residing at no.27/3, Serpartine street, Richmond town, Bangalore-560 025 4. Mrs. Sara Ayesha Siddique D/o. Mohammed Sadiq, Aged about 25 years, Building no. 9, 2nd D cross, Samadhana Nagar, K.G. Halli, Bengaluru-

560 045. Today at Bengaluru do hereby solemnly affirm and state on oath as follows. 1. We are well conversant with the facts of the above application. Hence, we are swearing to this joint affidavit. 2. The averments made in the accompanying application from para 1 to 3 for settlement and to quash the proceedings are true and correct to the best of our knowledge, information and belief. 3. Both of us Petitioners and respondent No.2 have settled the dispute and we have decided to put an end to the further criminal proceedings C.C No.54175/2023 are punishable under Section 498(A), 506, 420 of IPC and S.3 and 4 of D.P. Act which are pending in the file of the Hon'ble 29th A.C.M.M. at Mayo hall, Bengaluru, and the respondent No.2 has undertaken to withdraw the cases pending against the petitioners and we have entered into compromise voluntarily and out of free will for the purpose of maintaining good relationship. 4. We state that we have dissolved the marriage dated 27.02.2021 and as a full and final settlement as compensation the petitioners has paid Rs.6,00,000/- in D.D bearing no.845141 dated 27.09.2022 to the respondent no. 2 and we further state that the respondent no.2 shall not make any claim in the future from the petitioners either movable and immovable property. - 6 -

In view of this petitioners and respondent No.2 humbly prays before this Hon'ble Court be pleased to quash the chargesheet in C.C No.54175/2023 are punishable under Section 498(A), 506, 420 of IPC and S.3 and 4 of D.P. Act which are pending in the file of the Hon'ble 29th A.C.M.M. at Mayo hall, Bengaluru, in the interest of justice and equity.”

In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following:
ORDER
(i) The petition is disposed of in terms of Application – I.A.1/2025 and Joint Affidavit dated 15.07.2025.
(ii) The proceedings in C.C.No.54175/2023 (arising out of Crime No.63/2022 of 1st respondent – Police) registered for the offences punishable under Sections 498(A), 506, 420 of IPC and Sections 3 and 4 of Dowry Prohibition Act, pending on the file of 29th A.C.M.M., Bengaluru, insofar as the petitioners are concerned are hereby quashed.
