JUSTICE SANDEEP KUMAR ORAL ORDER 2 30-07-2025 Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners seek bail in connection with Sikta P.S. Case No. 56 of 2025 registered for the offence punishable under Sections 127(2), 308(3), 308(5) and 3(5) of the Bharatiya Nyaya Sanhita. 3. The petitioners are accused of kidnapping the victim and the victim was subsequently released. 4. During investigation, it has come that the victim Patna High Court CR. MISC. No.45170 of 2025(2) dt.30-07-2025 2/3 had taken some loan and for the recovery of loan, he was taken away by the petitioners and thereafter, he was released. The petitioners are in custody since 05.04.2025 and claim clean antecedent. 5. Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bettiah, West Champaran /concerned Court in connection with Sikta P.S. Case No. 56 of 2025. 6. As a condition of this order, the petitioners, after being released on bail are directed to co-operate in the trial either by appearing personally or through their lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioners. 7. At the time of accepting bail bonds of the petitioners, the Court below will verify the criminal antecedent of the petitioners. If it is found that the petitioners have criminal antecedent, the Court below shall not accept the bail bonds of the petitioners and if it is found that the petitioners have clean Patna High Court CR.
