1. Petition under Section 528 of the BNSS, 2023 has been filed for quashing of impugned order dated 24.02.2025 (Annexure P-4), passed by learned Special Court, Gurdaspur, whereby, the bail of the petitioner was cancelled and the bonds were forfeited to the State in NDPS case No.265 of 2023 pertaining to FIR No.6 dated 05.02.2023 registered under Section 22 of the NDPS Act at Police Station Behrampur, District Gurdaspur.

Learned counsel for the petitioner submits that the petitioner was granted benefit of regular bail by the Special Court, Gurdaspur. However, only on one date of hearing i.e. 24.02.2025, the petitioner could not appear before the trial Court as he was not feeling well. Thereafter, his bail order was cancelled and bail bonds were ordered to be forfeited to the State. He further POONAM BHATT 2025.05.28 17:16 I attest to the accuracy and authenticity of this

CRM-M-25206-2025 (O&M) 2 submits that the petitioner is ready to join the proceedings and would abide by all terms and conditions of the bail.
3. Notice of motion.
4. Mr. Gorav Kathuria, DAG, Punjab accepts notice on behalf of the respondent-State and does not oppose the factual aspects.
5. In view of the innocuous prayer made by learned counsel for the petitioner, filing of detailed reply is dispensed with.
6. In view of the above, the petitioner is directed to join the proceedings within a period of 10 days before the trial Court and would furnish his medical certificate showing the genuineness of his absence before the trial Court. On his appearance, he shall be admitted to bail on furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
7. In case of failure on the part of the petitioner, this order shall remain automatically vacated and learned trial Court shall be at liberty to proceed as per law.
8. Liberty is also reserved in favour of the complainant/State to seek cancellation/recalling of this order in case it is found that the petitioner has misrepresented the facts and upon showing any other sufficient cause.
9. The present petition is accordingly disposed of.
10. Pending miscellaneous application(s), if any, shall also stand
disposed of.
