JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 08-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. Petitioner seeks regular bail in connection with Nadi P. S. Case No. 74 of 2017 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 3. As per the prosecution case, 150 liters of counter made Mahua liquor were recovered from a Tempo bearing Reg. No. BR-01PH-6894. 4. Learned counsel for the petitioner submits that he is innocent and has committed no offence. He has been falsely implicated in this case only because he is owner of the vehicle in question. He has given the said vehicle to the driver on hire Patna High Court CR. MISC. No.42414 of 2025(2) dt.08-08-2025 2/2 and was not aware that the same has been used in an illegal transportation of liquor. Petitioner is in custody since 20.05.2025. 5. Learned A.P.P. for the State vehemently opposes the bail application. 6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge of Exclusive Special Court of Excise, Patna City (Patna) in connection with Nadi P.
