By means of this bail application, the applicant, who is involved in Case Crime No. 75 of 2025, under Sections 179, 180 BNS, police station Rorawar, district Aligarh, seeks enlargement on bail during the pendency of trial. As per prosecution case, in brief, the first information report has been lodged on 23.03.2025 for the offence under Section 179 and 180 BNS against Zikrul Hasan alias Rocky, applicant (Bariq) and Nazim. It is contended by learned counsel for the applicant that the applicant has been falsely implicated in this case showing false recovery of fake currency amounting to Rs. 13,500/- from possession of the applicant and fake currency amounting to Rs. 3,000/- from the possession of co-accused Zikrul Hasan alias Rocky. There is no independent witness of the recovery. The case of the applicant stands on identical footing to that of co-accused Zikrul Hasan, who has been granted bail by the coordinate Bench of this Court vide
order dated 01.09.2025 in Criminal Misc. Bail Application No. 23717 of 2025, a copy of said order has been produced by the learned counsel for the applicant, which is taken on record and hence the applicant is also entitled for bail on the ground of parity. The applicant does not have any criminal antecedent. Lastly, it is submitted by the
learned counsel for the applicant that there is no chance of the applicant of fleeing away from the judicial process or tampering with the prosecution evidence. The applicant is languishing in jail since 23.03.2025 and in case, the applicant is released on bail, he will not misuse the liberty of bail and cooperate with the trial. Per contra, learned Additional Government Advocate for the State opposed the prayer for bail of the applicant, but does not dispute the above factual aspect of the matter as argued on behalf of the Versus Counsel for Applicant(s) : Yogesh Mishra Counsel for Opposite Party(s) : G.A. Bariq .....Applicant(s) State of U.P. .....Opposite Party(s)
applicant. Having heard learned counsel for the parties and examined the matter in its entirety, I find substance in the submission of learned counsel for the applicant that co-accused Zikrul Hasan alias Rocky under similar accusation has been granted bail. Considering the facts and circumstances of the case as well as keeping in view the nature of the accusation, severity of punishment, evidence, complicity of the accused, this Court is of the opinion that the applicant has made out a case for bail on the ground of parity. Hence, the bail application is hereby allowed. Let the applicant Bariq, be released on bail in the aforesaid case crime number on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions: (i) That the applicant shall cooperate in the expeditious disposal of the trial and shall regularly attend the court unless inevitable. (iii) That after his release, the applicant shall not involve in any criminal activity. In case of breach of any of the conditions mentioned above, court concerned will be at liberty to cancel the bail. September 4, 2025 Ishrat BAIL No. 15392 of 2025 2 (Sanjay Kumar Singh,J.)
