Upon hearing the learned counsel for the petitioner and upon perusal of the materials available on record, it is the case of the petitioner that while executing a gift deed in favour of the Panchayat, in the course of developing a layout, an incorrect extent was inadvertently mentioned. In order to rectify the same, the petitioner has now sought to present a Declaration Deed. Per contra, the learned Additional Government Pleader, taking notice on behalf of the first respondent, would submit that the number mentioned by the petitioner in the prayer is only a receipt number and that the document has not yet been formally presented for appropriate orders before the Sub Registrar. 4. It is seen that though the second respondent Panchayat was impleaded by this Court and notice was ordered, effective instructions could not be obtained, since the Block Development Officer, who is presently in charge of the Panchayat as its Executive Officer, has not furnished the necessary inputs. 5. In view of the above, this Writ Petition is disposed of on the following terms: (i) The petitioner shall re-present the Declaration Deed dated 23.09.2025 within a period of two weeks from the date of receipt of a web copy of this order. (ii) Upon such presentation, the first respondent / Sub Registrar shall conduct an enquiry by issuing notice to the concerned Panchayat as well as to the Block Development Officer. _____________ Page No. 3 of 5 https://www.mhc.tn.gov.in/judis W.P.(MD)No.29648 of 2025 (iii) After affording an opportunity of hearing to all concerned parties, the first respondent shall take an appropriate decision in accordance with law and pass orders as expeditiously as possible, in any event, not later than four weeks from the date of presentation of the document.
