2. The present petition has been filed by the petitioner with the following prayers:
“A. That this Hon’ble Court may kindly quash and set aside the FIR No. 61 of 2023, dated 21.03.2023, registered with P.S. Vaishali Nagar, District Durg, against the petitioner for the offences under Section 34, 420 of the IPC, in the interest of justice; and B. That any other relief Hon’ble Court deems fit may also be granted.”
3. Learned State counsel submits on 07.02.2025, this Court has
directed the Director General of Police, Chhattisgarh to file his personal afÏdavit in the matter. In compliance of the same, Director General of Police, Chhattisgarh has filed his personal afÏdavit on 21.02.2025, which is on record. The relevant part of the same reads as under:
“3. That, by order dated 07.02.2025, this Hon’ble Court has directed the deponent herein to file his personal afÏdavit and an explanation also is called from the Superintendent of Police, Durg in this regard, by the next date of hearing. 4. That in compliance of the order passed by the Hon’ble Court, dated 07.02.2025, the deponent has immediately acted upon it and called an explanation of the Superintendent of Police, District Durg vide letter dated 13.02.2025. A copy of letter dated 13.02.2025, is being filed herewith as Annexure A/1. 3

That, on the same date, the deponent sent a letter to the Inspector General of Police, Durg mentioning about the observations and the instructions of the Hon’ble Court and to ensure strict compliance of the order and to further ensure disciplinary action against the erring ofÏcials. A copy of the letter dated 13.02.2025 addressed to Inspector General of Police, Durg is being filed herewith as Annexure A/2. 6. That, by the letter dated 19.02.2205, a report has been submitted by the Inspector General of Police, Range Durg to the deponent mentioning the actions taken by and explanation of the Superintendent of Police, Durg. A copy of the letter dated 19.02.2025, is being filed herewith as Annexure A/3. 7. The Superintendent of Police, Durg submitted his detailed explanation through Inspector General of Police, Range Durg on 19.02.2025 mentioning the description of the investigation conducted, directions issued to investigating ofÏcer, punishment for erring ofÏcials and he is personally supervising the case on day-to-day basis. A copy of letter dated 19.02.2025 is being filed herewith as Annexure A/4. 8. That, it is respectfully submitted that the Superintendent of Police, Durg has also imposed punishment on the erring ofÏcials. The copies of orders
4 of punishment against the erring ofÏcials are being collectively filed herewith as Annexure A/5. 9. That, it is respectfully submitted that the deponent sent a demi ofÏcial letter to the Superintendent of Police, Durg dated 19.02.2025 directing him to follow the directions and orders of the Hon’ble Court seriously and shall ensure discharge of his duties diligently in accordance with law.
A copy of letter dated 19.02.2025 is being filed herewith as Annexure A/6. 10. That, it is respectfully submitted that the deponent herein has highest regards and respect for the orders passed by this Hon’ble Court and the deponent herein is bound to comply the orders passed by this Hon’ble Court in its letter and spirit.”
4. It is further submitted by the learned State counsel that in the present matter, 10 persons have been arrested and the investigation is yet to be completed. 5. We have heard learned counsel for the parties and perused the prayers and pleadings made in the petition. 6. From perusal of the afÏdavit, it transpires that against the erring ofÏcials, action has been taken and the in the present case, the petitioner had already been granted anticipatory bail by the competent Court. 7. In view of the above, the concerned Investigating OfÏcer is directed to conclude the investigation and submit a report under Section 173(2) of
5 the Cr.P.C. (now under Section 193(3) of the BNSS) before the competent Court in accordance with law within a period of six weeks from the receipt of a certified copy of this order. 8.
