This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the action of respondents particularly respondents 4 and 5 at the instance of respondents 6 and 7 in sending police constables to petitioners' residence and insisting them to appear before their authority and yield to the terms of respondents 6 and 7 by handing over a portion of petitioners' landed property, admeasuring Ac. 0.20 cents out of Ac. 0.85 cents in D.No. 545/1 of Pagadamvaripalem Village, Rambhotlapalem Panchayat, Cherukupalli Mandal, Bapatia District.
This is being done despite the fact that the subject matter is pending adjudication in CRP No. 3278 of 2023, filed by petitioners against the 6th respondent before this Hon'ble Court., as illegal, irregular, irrational, without any authority of law and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents 4 and 5 not to interfere in any manner with petitioners' personal life and liberty nor insist them to appear before them for yielding to the terms of the respondents 6 and 7.”
2. Sri Kishore Kumari Katari, learned counsel for the Petitioners would submit that it is a case of interference of the Police in the civil disputes between the parties. 3. Sri P.Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, would submit that, this is a civil dispute between the Petitioners and the unofficial Respondents and the Police never interfered in the civil disputes between the parties. 3
4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed not to interfere with the civil disputes between the parties, except under due process of law. There shall be no order as to costs.
