PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 1 seeking to enlarge the Petitioners/Accused Nos.2 and 3 on bail in Crime No.21 of 2024 of Anantapur I Town Police Station, Ananthapuramu District, was registered against the Petitioners/Accused Nos.2 and 3 herein for the offences punishable under Sections 450, 307, 323, 324, 354 read with 34 of the Indian Penal Code, 1 The BNSS 2 18602 on the allegation that the Petitioners/Accused Nos.2 and 3 are involved in attempted murder, and assault with criminal force. 2. Heard the learned counsel for the petitioner, learned legal aid counsel for the 2nd respondent, and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the Petitioners along with other accused had earlier filed Crl.P.No.7808 of 2025 seeking pre-arrest bail. By order dated 01.08.2025, this Court declined to grant pre-arrest bail but granted liberty to the Petitioners to surrender before the concerned Court. Accordingly, the Petitioners and other accused surrendered on 18.08.2025 and have been in judicial custody for the past 58 days. The Petitioners, along with two others, subsequently filed Crl.P.No.9098 of 2025, which was dismissed as withdrawn on 12.09.2025 with liberty to file a fresh petition in accordance with law. 4. It is also noted that there are case and counter cases pending between one of the Petitioners/accused and the 2nd respondent in the present case. The 2nd respondent has been shown as one of the accused in Crime No.22 of 2024. As per the record, L.W.8 sustained grievous injuries, while the remaining seven witnesses suffered simple injuries. So far, fifteen witnesses have been examined. Substantial portion of the investigation, insofar as the alleged roles of the Petitioners are concerned, has been completed. Except for the Petitioners, the remaining accused have already been released either on pre-arrest bail or regular bail 2 The I.P.C 3 5. Considering the facts and circumstances of the case, the nature and gravity of the allegations leveled against the Petitioners/Accused Nos.2 and 3, this Court is inclined to enlarge the Petitioners/Accused Nos.2 and 3 on bail. 6. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioners/Accused Nos.2 and 3 shall be enlarged on bail subject to them executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for the like sum each to the satisfaction of the learned Principal Judicial Magistrate of I Class, Ananthapuramu. ii. The Petitioners/Accused Nos.2 and 3 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court. iii. The Petitioners/Accused Nos.2 and 3 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioners/Accused Nos.2 and 3 shall not commit or indulge in commission of any offence in future. v. The Petitioners/Accused Nos.2 and 3 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. vi. The Petitioners/Accused Nos.2 and 3 shall surrender their passport, if any, to the investigating officer. If they claim that they do not have a passport, they shall submit an affidavits to that effect to the Investigating Officer. _________________________ DR. Y.
