GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action on the part of Respondent No.3 in interfering into the civil disputes and also 2 insisting the petitioners to vacate their property to an extent of 388 sq. yards in Sy.No.11/8 of Talarivanipalem village, Gajuwaka Mandal, Visakhapatnam District and handover the same to the unofficial respondent as illegal, irregular, arbitrary violative of provisions of the Criminal Procedure Code and also Settled principles of law besides violation of the Articles 14, 21, and 300-A of Constitution of Indies and consequently direct the Respondent No.3 not to interfere with the civil disputes and not insist the petitioners to vacate from their properly an extent of 388 sq. yards in Sy.No.11/8 of Talarivanipalem village, Gajuwaka Mandal, Visakhapatnam District.” 2. When the matter is taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home would submit that in view of the interim order dated 17.02.2022 passed by a Coordinate Bench of this Court, the Police are not interfering in the civil disputes between the parties. 3. Sri Mangena Sreerama Rao, learned counsel for the Petitioners would submit that, recording the same, the petition may be disposed of. 4. For ready reference, the interim order dated 17.02.2022 passed by a Coordinate Bench of this Court, is extracted hereunder: “In the interim period, the 3rd respondent is directed not to interfere with the civil disputes pertaining to site measuring an extent of 388 square yards in Sy.No.11/8 of Talarivanipalem Village, Gajuwaka Mandal, Visakhapatnam District, if no case is registered against the petitioners.” 5. In the light of the above interim order, the Writ Petition is disposed of. However, Police are directed not to interfere in the civil disputes between the parties. There shall be no order as to costs.
