GP FOR HOME 2. 2 The Court made the following: ORDER: This Writ Petition under Article 226 of the Constitution of India, has been filed, by the Petitioner for the following relief: “ ... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondent No.1 in interfering with the matrimonial disputes between the petitioner and the respondent and insisting the petitioner to comply with the illegal demands of the respondent No.4 and thereby frequently summoning the petitioner to the police station and harassing the petitioner without following due process of law as arbitrary, illegal and violation of Articles 14 and 21 of the Constitution of India and consequently direct the respondent No.1 not to interfere with the matrimonial disputes between the petitioner and respondent No.4 without following due process of law in the interest of justice. ...” Heard learned counsel for the Petitioner and Learned Assistant Government Pleader for Home representing for respondent State. Perused the material on record. Learned Assistant Government Pleader on instructions would submit that respondent No.4, who is the wife of Petitioner herein, came to the Police Station and gave a report against the Petitioner. Petitioner was called to the Police Station for family counselling. During counselling, the parties raised several allegations against each other and the matter is postponed. Thereafter, petitioner and respondent No.4 did not come to the Police Station. Except that, respondent Police never interfered in the matrimonial matters of the parties. Learned Assistant Government Pleader requested to dispose of the Writ Petition by passing appropriate orders. Recording the submissions made, this Writ Petition is disposed of. Respondent Police are directed not to interfere in the matrimonial disputes 3 between the Petitioner and respondent No.4, except under due process of law. No order as to costs.
