ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of a Writ of Mandamus, declaring the action of the respondents, particularly Respondents 1 and 2, in not considering the representations dated 01.08.2024 made for deletion of my residential house with R.C.C. roof (Daba), bearing Door No. 1-1-1/2, admeasuring 200 sq. yards in Survey No. 633, situated at Pension Lane, Samalkot, pertaining to my late father Sri Putta Samuel Prabhakar Rao, S/o Isaac, from the R.S.R. of Samalkot Revenue Limits, and in including the same in the R.S.R. without conducting any enquiry or giving reasonable opportunity to the title holders of the property, as highly illegal, arbitrary, unjust, improper, violative of the principles of natural justice, and violative of Articles 14, 21, and 300-A of the Constitution of India; and consequently direct Respondents 1 and 2 to dispose of the representation dated 01.08.2024 after affording an opportunity of personal hearing to the petitioner and to pass such other…”

Learned counsel for the petitioner submits that the petitioner purchased the property under a registered sale deed in 1974 and has been in possession of the subject property. The petitioner thereafter applied for survey, which was conducted, and a survey report dated 27.11.2023 was issued. In the said report, the respondents clearly recorded that the subject residential property situated in Samalkot Revenue Village falls within

Survey No. 633 and is shown as R.S.R. Thereafter, the petitioner approached the 2nd respondent through a representation dated 01.08.2024 requesting deletion of the property from the list of R.S.R.

Considering the said representation and the registered documents filed along with the writ petition, the Writ Petition is disposed of directing the respondents, particularly the 2nd respondent, to consider the petitioner’s representation and pass appropriate orders based on the available records and, if necessary, after conducting a proper enquiry, within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.
Consequently, miscellaneous applications pending, if any, shall stand closed.
