GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 2753/2024 ORDER: The present Writ Petition is filed questioning the action of the Respondents in not paying compensation or granting TDR rights for the acquisition of part of schedule property i.e., an extent of 7.6 Ankanams/273.6 sq. ft/30.4 Sq.Yds out of an extent of 31.06 Ankanams/1118.25 Sq.ft/124.25 Sq.Yards in S.No.623/3C and 8A/1D (Plot No.2) of Tirupati Village Accounts nearer to Chinthalachenu as illegal and arbitrary. 2. The Petitioner claims to be the owner of an extent of 124.25 Sq.Yards having purchased the same under registered Sale Deed dated 30.08.2004 vide Document No.6505 of 2004. It is pleaded that the Respondent Authorities had laid a road in an extent of 7.6 Ankanams/273.6 sq. ft/30.4 Sq.yards without any prior notice or acquiring the schedule property. Thereupon, the Petitioner requested the Respondent No.2 for grant of compensation or issue TDR for the land used for laying the road. A written representation was also said to have been issued on 13.07.2023 for grant of compensation or TDR for the said 3 land. As the representation of the Petitioner is not considered, the present Writ Petition is filed. 3. During the course of arguments, learned counsel for the Petitioner submitted that the relief in the Writ Petition is restricted for issuance of TDR rather than compensation. 4. Learned Standing Counsel for the Respondent Corporation submits that Sy.Nos.623/3C & 8A/1 of Tirupati Village accounts are kept in prohibited list by the Inam Deputy Tahsildar, Chittor and the said property stood confirmed in favour of Tirumala Tirupati Devasthanams, Tirupati. It is stated that an appeal was filed before the Revenue Divisional Officer, Tirupati under Inam Abolition Act and the same is pending. As the ownership of the Petitioner is not confirmed, the representation of the Petitioner is kept in abeyance and action would be initiated for issuance of TDR upon finalization of the title. 5. In that view, this Court is of the opinion that the present Writ Petition can be disposed of with the following direction: 4 i) The Respondent Authorities shall consider the representation of the Petitioner for issuance of TDR upon disposal of the appeal pending before the Revenue Divisional Officer, Tirupathi, under Inam Abolition Act. 6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
