Learned counsel for the petitioners submits that despite the judgment in CWP No. 28133 of 2019 titled as Dalip Kaur and others Vs. State of Punjab and others, decided on 14.11.2023, passed by this Court in the case of the similarly situated employees, the claim of the petitioners has been rejected by the respondents while passing order dated 11.03.2025 Kanchan 2025.05.13 17:34 I attest to the accuracy and integrity of this order/judgment CWP No. 13456 of 2025 and CWP No. 13470 of 2025 2 (Annexure P-3) in CWP No. 13456 of 2025 and order dated 02.04.2025 in CWP No. 13470 of 2025 which is in direct violation of the judgment in Dalip Kaur’s case (supra) and the said impugned orders amounts to contempt as, the respondents are following the directions of the Finance Department rather than following the judgment of the Court. 2. Notice of motion. 3. On the asking of the Court, Mr. T.P.S. Chawla, Senior Deputy Advocate General, Punjab, who is present in Court, accepts notice on behalf of the respondent-State and Mr. Aman Sharma, Advocate appears on behalf of respondent No. 4-PWRMDC. 4. Learned counsel appearing on behalf of respondent No. 4- PWRMDC submits that keeping in view the instructions received from the Managing Director, PWRMDC who has passed the order, who is also present in Court, the impugned order be treated as withdrawn with liberty to pass a fresh order keeping in view the settled principle of law, which order will be passed within a period of ten days from today. 5. Learned counsel further submits that the efforts are also being made that the direction should come from the Finance Department to implement the judgment in Dalip Kaur’s case (supra) and in all the connected cases so that there is no ambiguity or violation of the orders passed by this Court. 6. Learned counsel for the petitioners submits that in view of the statement of learned counsel for the respondents, the present petitions may kindly be disposed of having been not pressed any further.
