THE HON’BLE SRI JUSTICE BATTU DEVANAND WRIT PETITION NO.28556 of 2013 ORDER: 1. This Writ Petition is filed seeking Writ of Mandamus declaring the action of respondent Nos.3 to 6 in harassing the petitioner’s husband i.e., Mr.Suggu Rami Reddy, at the instance of respondent No.7 by registering false case and arresting her husband in the said vexatious case as illegal, arbitrary, high handed and violative of Articles 14 and 19 of the Constitution of India and sought consequent direction to the respondent Nos.3 to 6 not to arrest her husband in the case registered against him. 2. On 21.06.2024, this Court observed that the learned counsel for the petitioner was elevated as a Judge of this Court and accordingly, directed the Registry to issue notice to the petitioner. Until 26.09.2025, there is no response from the petitioner. However, on 26.09.2025, this Court directed the Registrar (Judicial) to verify whether the notice is served on the petitioner or not and to submit a report. Accordingly, the Registrar (Judicial) submitted a report, dated 09.10.2025 wherein, it is stated that to ascertain the status of the postal article/notice, a letter, dated 08.10.2025 has been addressed to the Head Post Master, Head Post Office, Guntur and in turn, vide 2 letter, dated 09.10.2025, the Superintendent of the Post Office, Guntur Division informed that the registered letter was delivered to the addressee i.e., the petitioner herein. 3. It appears that in spite of receiving notice from the Court, there is no appearance for the petitioner either in person or through an Advocate to prosecute her case. 4. The Writ Petition is pertaining to the year 2013 and in view of the above factual position, it appears that the petitioner has no interest to prosecute the case. 5. Accordingly, the Writ Petition is dismissed as non prosecution. No costs.
