Respondent No.4 had invited tenders for construction of compound wall to Compose Yard in Nandyal Municipality on 12.08.2018. Pursuant thereto, the Petitioner had awarded the work vide an agreement referred above. The Petitioner had executed the work entrusted by the Respondent Authorities. After execution of the work by the Petitioner, out of Rs.67,57,387/-, the Respondents had paid Rs.60,97,491/- after deduction of EMD and PSD amounts and an amount of Rs.4,93,820/- is due to the Petitioner. 3. Learned Standing Counsel appearing for the Respondents while the Written Instructions signed by the Commissioner, Nandyal passing on Municipality admitted the execution of works and the amount due to the it is stated in the Written Instructions that due to financial Petitioner. priorities, the amounts to the Petitioner could not be paid. 3 4. Since the execution of work and the approval of the bill in dispute as per the instructions of the learned Standing Counsel Court deems it appropriate to dispose of the Writ Petition with the following direction; are not this i) The respondents are directed to make the payment of the amount due to the Petitioner, after taking into consideration the amounts paid to the Petitioner, within a period of Four months from today. ii) There shall be no order as to costs.
