This is a plaintiff's petition. In the suit instituted by the plaintiff, an application for grant of temporary injunction was moved which was allowed by the trial Court. It is alleged that the defendants have violated the interim injunction order, which led to filing of an application under Order 39 Rule 2-A CPC in the year 2024, which has been registered as Misc. Case No.9 of 2024, which is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the said case. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Civil Judge (Junior Division), Dumariyaganj, Siddhartha Nagar to decide the Misc. Case No.09 of 2024, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
