This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- “a) Issue a writ of Mandamus or any other appropriate writ directing Respondent No. 4 (Reserve Bank of India) to conduct a thorough inquiry into the functioning and loan recovery practices of Respondent No. 6, including its compliance with the Fair Practices Code issued under Section 45L of the RBI Act, 1934; and b) Issue a writ of Mandamus or appropriate direction to Respondent No. 5 (Delhi Police) to cease all forms of harassment and initiate appropriate disciplinary and criminal action against officials acting in collusion with Respondent No. 6, including This is a digitally signed order. The Order is downloaded from the DHC Server on 24/07/2026 at 12:35:27 impersonation of police officers and illegal coercion; and c) Direct Respondent No. 4 (Reserve Bank of India) to frame robust enforcement mechanisms and grievance redressal platforms against private NBFCs engaged in unethical lending and recovery practices, particularly targeting vulnerable classes such as women entrepreneurs, widows, and MSMEs; and d) Grant compensatory costs and damages, quantified as may be determined by this Hon’ble Court, for the physical, mental, and financial trauma suffered by the Petitioner due to the unlawful acts and omissions of Respondents No. 5 to 7; and e) Issue appropriate orders for institutional reforms in the oversight of NBFCs operating across state boundaries, ensuring that no NBFC is permitted to initiate criminal proceedings outside the jurisdiction of the borrower’s residence without express judicial permission, thereby protecting access to justice; and...” 2. The case of the petitioner is that the petitioner is a widow and a woman entrepreneur and is a victim of fraudulent practices, procedural lapses and harassment at the behest of respondent No. 6. 3. It is also stated that respondent No. 6 has manipulated loan documents, misused unsigned checks and is exploiting borrowers like the petitioner. The petitioner has stated the incidents from paragraph No. 6 onwards of the petition. 4. I am of the view that the allegations made by the petitioner must be looked into by the regulatory authority. 5.
