No. 862/2003 and take action forthwith, and pass 2 IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondent Nos. 2 to 5 to consider the representation of the petitioner dated 05.10.2021 by conducting enquiry with regard to misappropriation of funds in Press Club, Amalapuram, East Godavari District Regd. GP FOR REVENUE 3 The Court made the following: ORDER: This Writ Petition under Article 226 of the Constitution of India is filed by the Petitioner seeking the following relief: “... to issue a writ, order or direction more particularly in the nature of Mandamus declaring the action of the Respondents 2 to 5 in not taking any action for conducting enquiry in relating to misappropriation of funds in Press Club, Amalapuram, East Godavari District Regd.No.862/2003 as illegal, arbitrary and contrary to law, against principles of natural justice and contrary to Article 14 of Constitution of India and consequently to direct the Respondents 2 to 5 to consider the representation of the petitioner dated 05.10.2021 by conducting enquiry with regard to the misappropriation of funds in Press Club, Amalapuram, East Godavari District Regd. No. 862/2003 and take action forthwith, and pass ....” Heard learned counsel for the Petitioner and learned Assistant Government Pleader for Home appearing for respondent State. Perused the material on record. Learned Assistant Government Pleader for Home on written instructions would submit that Petitioner submitted a representation to the Press Council of India, New Delhi but not presented any report to the respondent Police in connection with misappropriation of the funds in Press Club, Amamapuram, East Godavari District and in that connection, no relevant documents are presented to the respondent Police. If any complaint is received from the Petitioner, respondent Police will act according to law and would submit that let there be a direction to the Petitioner to submit relevant documents in support of the allegations to the respondent Police and then, the Police will proceed further in the matter according to law. 4 In that view, this Writ Petition is disposed of. Petitioner is directed to pursue the matter before the concerned Police Station by furnishing relevant documents. On receipt of the same, the concerned Police shall proceed further with the matter according to law. No order as to costs. Pending applications, if any, shall stand closed.
