JUDGMENT
1. The petitioner, who is 68 years of age, has filed this petition, challenging the order dated 08.02.2023, whereby the petitioner was dismissed as Lambardar of village Pehra Tehsil Khawas District Rajouri. Challenge has also been thrown to order dated 11.02.2023, whereby the respondent No. 6 has been appointed as Substitute Lambardar in place of the petitioner.

The order dated 08.02.2023 was passed by the respondents on the premise that the petitioner was non-cooperative and was not performing his duties and vide order dated 11.02.2023, the respondent No. 6 was appointed as Substitute Lambardar on temporary basis of village Pehra Tehsil Khawas District Rajouri for a period of six months or till elections are held.

Learned counsel for the petitioner has submitted that the present petition may be disposed of by directing the official respondents to conduct the elections within a stipulated period.

In view of the submissions made by the learned counsel for the petitioner and after taking into consideration the fact that the petitioner has crossed the age of 60 years, the present petition is disposed of by directing the official respondents to conduct the elections for the post of Lambardar of village Pehra Tehsil Khawas District Rajouri in accordance with law within a period of three months from the date of receipt of copy of this order and till then respondent No. 6 shall continue as Substitute Lambardar. Needless to say that the official respondents shall release the arrears of remuneration/salary in favour of the petitioner, if any due.
