Earlier prayer for bail of the petitioner was rejected twice on merits vide order dated 24.08.2023 passed in B.A. No.4554 of 2023 and vide order dated 12.07.2024 passed in B.A. No.4266 of 2024 wherein direction was given to the learned Trial Court to conclude the trial at the earliest preferably within six months. The petitioner named above has renewed his prayer for regular bail in connection with Giridih (Cyber) P.S. Case No. 09 of 2023 for the offence under Sections 413, 414, 419, 420, 467, 468, 471 of the I.P.C. and Sections 66(B), 66 (C) and 66 (D) of the I.T. Act, pending in the court of Addl. Sessions Judge- II-cum-Special Judge (Cyber Crime), Giridih or its successour court. Heard the parties. It is submitted by learned Sr. counsel for the petitioner that he is in custody since 20.03.2023 and from the date of last order i.e. 12.07.2024 passed by this Court, more than six months have already elapsed and out of eleven witnesses, only five witnesses have been examined, as such, this Hon’ble Court may consider the same. Learned APP for the State has vehemently opposed the prayer. Considering the submissions of learned counsel and the fact as discussed above, the bail application is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below subject to the condition that one of the bailor(s) must be close relatives of the petitioner and that he shall not commit an offence, similar to the offence of which he is accused in the present case.
