GP FOR HOME 2 The Court made the following: ORDER: This Writ Petition under Article 226 of the Constitution of India, has been filed, by the Petitioner for the following relief: “ ... to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus (a) declaring the action of the Respondent No.3 in intervening and trying to mediate and decide and direct in a civil dispute issues alleged to be raised by between Writ Petitioners mother Lakshmamma or Brothers (i) Suvarapu Ramanaiah (ii) Suvarapu Gurrappa and (iii) Suvarapu Lakshmiah, and the Writ Petitioner and calling the Writ Petitioner to the Respondent No.3 police station for the above mentioned alleged civil issues disputes is totally Arbitrary objectionable and beyond the powers given to the Respondent No.3 police and (b) Directing the Respondent No.3 not to intervene and try to mediate and decide and direct the Writ Petitioner in an alleged civil disputes issues ...” Heard learned counsel for the Petitioner and learned Assistant Government Pleader for Home representing for respondent State. Perused the material on record. It is a case of interference of the Police in the civil disputes pending between the parties. Learned Assistant Government Pleader on instructions would submit that there are civil disputes between the Petitioner and his brother with regard to gold ornaments and cash. Based on the complaint lodged by Smt.Suvarapu Lakshmamma, who is mother of the Petitioner, a case in Crime No.316 of 2024 of Piler Urban Police Station is registered. During investigation, it revealed that her son S.Rangaiah along with his wife and daughter, allegedly harassed his mother (complainant) caused her undue suffering after spending her gold ornaments and cash and neglected her welfare. Further, Petitioner herein lodged a complaint against his brothers, which is registered as a case in Crime No.256 3 of 2024 of Piler Police Station, Annamayya District and after completion of investigation, charge sheet is filed which is numbered as CC No.274 of 2024. Learned Assistant Government Pleader would further submit that respondent Police did not interfere in the civil disputes between the parties and requested to dispose of the Writ Petition by passing appropriate orders. Learned counsel for the Petitioner would submit that recording the said submission, this Writ Petition may be disposed of by passing appropriate orders. Recording the submissions made, this Writ Petition is disposed of. Respondent Police are directed to follow due process of law with regard to the subject matter. No order as to costs.
