In this writ petition, the petitioner is assailing the Notice dated 08.02.2023 (Annexure-A) issued by the Respondent. 3. Having taken note of the submission made by the learned counsel appearing for the parties, perused the order dated 16.12.2022 passed by this Court in W.P.No.25311 of 2022 (Annexure-B), wherein a direction has been issued to the Respondent No.5 (Tahsildar, Periyapatna Taluk) to issue notice to the petitioner within 15 days from the date of receipt of certified copy of the Order and, after providing sufficient opportunity to the petitioner, to pass a detailed order in accordance with law. Pursuant to the Order passed by this Court in the aforesaid writ petition, the petitioner has addressed a Letter dated 06.02.2023 (Annexure-C), for which the Respondent has issued the impugned Notice at Annexure-A. 4. Having perused the reply given by the petitioner dated 06.02.2023 (Annexure-C) to the Notice dated 24.01.2023 issued by the respondent, further the Notice dated 08.02.2023 (Annexure-A) and the Order passed by this Court in the writ petition referred to above, I am of the view that, the - 3 - HC-KAR NC: 2025:KHC:47548 WP No. 3460 of 2023 respondent is to be directed to pass a speaking order considering the entire aspect of the matter, with detailed reasons, within four weeks from the date of receipt of a copy of this order. 5. With the aforesaid observations, I pass the following: ORDER i) Writ petition is allowed; ii) Notice 08.02.2023 at Annexure-A is set aside; iii) Matter is remitted to the respondent with a direction to pass fresh orders in accordance with law, in the light of the observation made in the Order dated 16.12.2022 passed by this Court in W.P.No.25311 of 2022 (Annexure-B); iv) Interim order granted by this Court on 13.02.2023 shall continue till a fresh order is passed by the respondent, as mentioned supra.
