This is an appeal under Section 378 (4) Cr.P.C. filed against the judgment and order dated 10.01.1980, passed by Special Judicial Magistrate, First Class, Meerut in case no. of 1978 acquitting the accused under Sections 147/ 323/ 452 IPC. 3. There is an office report dated 15.09.2025 which reads as under: "In compliance of Hon'ble Court's order dated 05.08.2025, the CJM, Meerut vide letter dated 08.09.2025 (flag 'E') has reported that appellant/ complainant Shyam Lal and opposite party no. (1) Ishak Lal, (2) Mohan Singh, (3) Jai Prakash, (4) Kailash and (5) Bishamber have died. The case is put for hearing." 4. As per the office report dated 15.09.2025, reference to a report of the CJM dated 04.09.2025 whereby the appellant is stated to have expired on 09.10.2017 and accused-opposite party nos. 1, 2, 3 and 4 on 16.03.2003, 02.03.2008, 26.10.2017 and 08.01.2011 and the fifth opposite party, Bishamber has also expired. There are supporting documents also annexed with the report of CJM, Meerut. 5. Since the appellant had already expired, thus, the appeal stands abated against them. 6.
