Application under Section 5 of Limitation Act has been filed for condonation of delay of 5114 days in filing the Appeal. 2. It is submitted in the Application that the certified copy was applied for on 16.11.2010 vide Receipt No. 91486 and was delivered on 24.12.2010, i.e., after 38 days. The Appellant, therefore, moved an Application in the Award dated 08.08.2011. He then moved an Appeal in the Order dated 17.10.2012. Now an Appeal bearing FAO No. 12/13 was filed which got decided on 26.03.2024 and OMP No. 862/2014 is still pending before this Court. It is, therefore, submitted that the delay of 5114 days in filing the Appeal be condoned. 3. Appellant who is appearing in person states that he has filed an Application for empanelment before the learned Arbitrator, which has not met any favourable order. This is a digitally signed order. The present Suit was in respect of damages and harassment caused to the Plaintiff for which he had claimed Rs.20 lakhs. The Suit got dismissed vide judgment dated 10.11.2010. 5. The grounds stated in the Application have no bearing to the present Appeal and does not disclose any reason for condonation of delay of 5114 days. 6. The Application is hereby dismissed. Consequently, the Appeal along with pending Applications, stands dismissed. 7. The next date of hearing fixed before the learned JR, i.e. 29.09.2026, stands cancelled.
