THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 299 of 2024
ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer:
“…issue a writ or direction, more particularly, a writ of Mandamus, i. to declare the action of the 4th and 5th respondents in asking the writ petitioner to appear at the Ibrahimpatnam P.S., Ibrahimpatnam, NTR district and asking the petitioner to produce the house site documents pertaining to the site situated at Survey No.76/2 in an extent of 0-04 cents (1965 sq.yds). Plot No.9, Block No.3, Ibrahimpatnam Village and Mandal and trying to interfere with possession and enjoyment of the petitioner with regard to his house site, as illegal and without jurisdiction ii.and consequently direct the 4th and 5th respondents not to harass the writ petitioner by asking the petitioner to appear before them at the police station to produce the documents pertaining to house site in the name of resolving a civil dispute and not to threaten the petitioner with dispossession iii. Direct the respondent Nos. 2 and 3 to take appropriate action against the 4th and 5th respondents for causing harassment to the petitioner in name of a civil dispute.…”
2. Heard Sri N.Bharat Babu, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for the respondents.

Learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the representation of one Sri Yeddanapudi Jayakar, the parties were called to the police station for enquiry. They have not registered any crime, since, the subject matter is civil in nature. He would further submit that on 26.12.2023 on credible information about the

quarrel between the petitioner and the above Y.Jayakar, the 5th respondent addressed a letter requesting the Tahsildar to issue 145 Cr.P.C., proceedings in this matter.

Learned counsel for the petitioner would submit that the petitioner herein is no more and the Court may pass appropriate Orders.
5. Recording the above said submissions, this Writ Petition is disposed of. However, the legal heirs of the petitioner are at liberty to file a fresh petition, if so advised. No costs.
