Neutral Citation No. - 2025:AHC:80959 Court No. - 35 Case :- WRIT - C No. - 14625 of 2025 Petitioner :- Rahul Bind And 7 Others Respondent :- State Of Up And 7 Others Counsel for Petitioner :- Prem Prakash Counsel for Respondent :- C.S.C.,Pradeep Singh Hon'ble Manish Kumar Nigam,J. 1. Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for the following relief: "Issue a writ, order or direction in the nature of certiorari quashing the impugned Order dated 30.12.2024 passed by Additional Commissioner/Respondent No.2 in Case No.707 of 2023 (Computerized Case No.C202316000000707) [Moolchand (deceased) through Jay Shankar & Ors. Vs. Bhola & Ors.] under Section 219 of the U.P. Land Revenue Act, 1901 as well as Order dated 30.12.2009 passed by the Respondent No. 3/District Magistrate in Case No. 16/79 of 2008 [Bhola Vs. Moolchand & Ors.] under Section 219 of the U.P. Land Revenue Act, 1901." 3. In a pending proceedings for mutation on the basis of lease deed initiated by the petitioners, an application for impleadment along with objection was filed by contesting respondents. The said application was rejected. Thereafter, the contesting respondents filed a revision and the same was allowed and the respondents were directed to be impleaded as party. The petitioners preferred a further revision which has been dismissed by order impugned. 4. From the perusal of the application as well as order passed it is apparent that no illegality has been committed as the allegations made in the objections are that the petitioners want to get their name mutated on the basis of a forged lease and the contesting respondents are in possession over the land in dispute. 5. In my view, no illegality has been committed by the courts below in directing the contesting respondents to be impleaded as party. 6. Writ petition lacks merit and is accordingly, dismissed. 7. It is made clear that this Court has not examined the objections of the contesting respondents on merits and the courts below are directed to decide the matter strictly in accordance with law.
