Mr. AK Kanu, the learned counsel appearing on behalf of the petitioners, who submits that taking into account that the instant proceedings was only
directed against the refusal to pass an ex-parte order of stay to the execution proceedings and presently the execution proceedings is going on wherein the decree holder is appearing, the instant petition has become infructuous.
2. Taking into account the above, the instant proceedings stands closed as it has become infructuous.
3. Interim order, if any, stands vacated.
