JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 02-07-2025 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 3. As per the prosecution case, 437.475 litres of illicit Indian made foreign liquor has been recovered from open field. 4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Name of petitioner transpired in the present case on the basis of disclosure made by mahal chowkidar. Nothing has been recovered from the conscious possession of the petitioner. Patna High Court CR. Considering the quantity of recovery and also the fact that petitioner carries five criminal antecedents, out of which two are of similar nature as mentioned in paragraph no. 3 of the bail petition, the prayer for anticipatory bail of petitioner is rejected.
