Raghunandan Rao) ...CONTEMNOR The Writ Petition No.25345 of 2024 came to be filed before this Court, by the petitioner therein, with the complaint that her husband had been illegally detained without being produced before the Magistrate. On 08.11.2024, when the matter was came up for hearing, the Learned Government Pleader appearing in the office of the Learned Advocate General, on instructions, stated that the detenue had been produced before the concerned Magistrate, on 07.11.2024 itself and had been remanded to judicial custody. I 2. As the allegation in the Writ Petition was that the detenue had been kept under illegal custody from 25.10.2024, the case file was directed to produce before this Court, on 11.11.2024. On 11.11.2024, this Court was informed that the case file had been retained by the Learned 11 Additional Judicial First Class Magistrate, Bhimavaram and that there is some difficulty in producing it. 3. 2 The matter was then posted to 12,11.2025, for production of the case file. On 12.11.2024, this Court was informed that application had been filed for obtaining certified copies of the original case file. 4. This Court, after observing that the direction was to produce the original file and applying for certified copies is not compliance of the directions of this Court, had initiated Suo moto contempt against the respondent herein. The respondent herein is personally present before the Court 5. 6. today. Smt. A. Jayanthi, learned counsel for the respondent would submit that 08.11.2024 was a Friday and the next date of functioning of the Court was 11.11.2024. She further submits that the presiding officer absent on 11.11.2024 and consequently, steps could not be taken to obtain the original file. She would also submit that a separate memo had also been filed, on 11.11.2024 for returning the original case file for production before this Court and the Magistrate had returned the memo on the ground that the Order of this Court, dated 08.11.2024, had not been received by the Magistrate. She would submit that all steps are compliance of the directions of this Court had been taken and that there was no willful non-compliance or violation of the directions of this Court. Keeping in view of the above facts, this Suo moto Contempt Case is closed. There shall be no order as to costs. As a sequel, interlocutory applications pending, if any shall stand 7. was 8. closed.
