GP FOR HOME (AP) 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 3103 of 2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue a Writ of Mandamus or any other appropriate Writ, Order, or direction declaring the action of Respondents, particularly 4th Respondent herein, in calling and harassing the petitioner without any material against them as arbitrary, illegal, unwarranted, unconstitutional and against the principles of Natural Justice and violation of Article 21 of the Constitution of India and consequently direct the Respondents, particularly 4th Respondent herein, not to interfere with the suit land and personal liberty of the Petitioner.…” 2. Heard Sri Lakshmikanth Reddy Desai, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the respondent- police are harassing the petitioner by calling him to the police station without there being any crime registered against him. 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the complaint of one Kudavelli Venkata Rami Reddy, a case in Cr.No.255 of 2023 under Sections 427, 447, 420, 506 r/w 34 of IPC of Kurnool IV Town P.S., against the petitioner and another. He would further submit that except for the purpose of investigation, the police never called the petitioner to the police station for any other purpose. 3 5. Recording the same, this Writ Petition is disposed of. There shall be no order as to costs. However, the police are directed to follow due process of law regarding the crime which has been registered against the petitioner.
