Neutral Citation No. - 2025:AHC:83493-DB Court No. - 40 Case :- WRIT - C No. - 15032 of 2025 Petitioner :- Jagmohan Singh Respondent :- Dakshinanchal Electricity Distribution And 2 Others Counsel for Petitioner :- Puneet Bhadauria Counsel for Respondent :- Manu Ghildyal Hon'ble Shekhar B. Saraf,J. Hon'ble Dr. Yogendra Kumar Srivastava,J. Heard Sri Puneet Bhadauria, learned counsel appearing for the petitioner and Sri Ishan Mishra, learned Advocate holding brief of Sri Manu Ghildyal, learned counsel appearing for the respondents, the Electricity Distribution Corporation. This is a writ petition under Article 226 of the Constitution of India, wherein the petitioner has sought a direction to the respondents to grant Electricity Connection to him forthwith, in pursuance of his application dated August 23, 2024, filed for the purpose; and a further direction for determining the Final Assessment after considering the objections against the Preliminary Assessment, after affording the petitioner a proper opportunity of hearing, within a stipulated time period. Counsel appearing for respondents, the Electricity Distribution Corporation, has produced the final assessment dated September 19, 2024, which clearly indicates that an objection was filed by the petitioner and thereafter he was heard before passing the final assessment order. In light of the same, we do not find any reason to intervene at this stage and accordingly, the writ petition is disposed of with a
direction given to the petitioner to file an appeal, under Section 127 of the Electricity Act, 2003, within a period of three weeks from date. If such an appeal is filed by the petitioner, within the aforesaid period, the authority concerned shall hear the matter expeditiously and preferably within a period of eight weeks from date of filing of the said appeal, and shall pass a reasoned order thereupon, in accordance with law.
