GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: 2 “.... a Writ of Mandamus declaring the action of the Respondents No. 3 and 4 in interfering in Matrimonial Disputes and pressurizing the 1st Petitioner to withdraw MOP No. 15/2024 on the file Senior Civil Judge, Adhoni and interfering with personnel life liberty of petitioners without any legal cause as illegal detention and interfering with personal liberty of the petitioners without any legal cause as illegal, arbitrary and violation of Article 19, 21 and 300-A of the Constitution of India and consequently direct the Respondents No. 3 and 4 to forbear from interfering with the life and personal liberty of the petitioners, not to pressurize for withdrawal MOP No. 15/2024 on the file Senior Civil Judge, Adhoni.” 2. Sri P.Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint given by the wife of Petitioner No.1 herein, who is the daughter of Respondent No.5, a case in Crime No.74 of 2024 for the offence under Section 85 read with 3(5) of BNS and Sections 3 and 4 of D.P. Act has been registered against the Petitioner and in connection with the said crime, the Police called the Petitioners to the Police Station to serve notice under Section 35(3) of BNSS. It is further submitted that the Police never pressurized the Petitioners to settle the matrimonial disputes. 3. Sri O.Udaya Kumar, learned counsel for the Petitioners would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed not to interfere in the matrimonial disputes between the Petitioners and Respondent No.5, except under due process of law. There shall be no order as to costs.
