Order or direction, particularly a Writ of Mandamus declaring action of the respondent No 4 in admeasuring Ac.0.050 cents in survey No 762/A1 and Ac.0.050 cents in survey No 762/B2 of Bodemmanuru Revenue Village, Uyyalavada Mandal, Nandyal District, without invoking the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 or any other provisions of law, as illegal, irregular, unjust, high handed besides arbitrary and violative of Articles 14 and 21 of Constitution of India and consequently direct the respondent No 4 not to form any road from the land of the petitioner admeasuring Ac.0.050 cents in survey No 762/A1 and Ac.0.050 cents in survey No 762/B2 of Bodemmanuru Revenue Village, Uyyalavada Mandal, Nandyal District, without there being any land acquisition proceedings or any recourse to law ….” 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader appearing for the respondents. 4 3. Learned Assistant Government Pleader has placed the written instructions received from the Tahsildar, Uyyalawada. According to the said instructions, the subject land was acquired for expanding the National Highways NH-167K from Nandyal to Jammalamadugu and notification under Section 3A of the National Highways Act, 1956 was issued on 14.02.2023 and the award amount will be paid after online data verification is completed. 4. In the said circumstances, the Writ Petition is disposed of directing the respondents not to dispossess the petitioner from the subject land without following due process of law by paying compensation. There shall be no order as to costs.
